Pursuant to Article 47 paragraphs (2) and (6) of the Law on Public Procurement No. 131/2015, the contracting authority is reducing the time limit stipulated in paragraph (2) of the same article; since the contracting authority has published the entire procurement documentation electronically and allows direct and unrestricted access to said documentation for economic operators—starting from the date of publication of the contract notice—and accepts the electronic submission of tenders, it is entitled to reduce the time limits provided for in paragraph (2) by 5 days.

Special conditions on which the fulfillment of the contract depends: According to Annex no. 3 of The Specifications Part II. from the Model-contract.

Offers are presented in currency: Moldovan lei (MDL) or USD, EUR. For evaluation purposes, offers submitted in foreign currency shall be converted into Moldovan lei at the deadline for submission of offers, using the official exchange rate of the National Bank of Moldova.

The evaluation criterion applied for the award of the contract: Best price-quality ratio

Evaluation shall be made on a lot basis, based on the bidder’s compliance with all mandatory minimum technical requirements.

Unit prices, excluding VAT, must be indicated with two decimal places. In case of discrepancy between the sum of unit prices and the total offered price, the unit price shall prevail and the total amount will be adjusted accordingly, with the economic operator’s consent.

Additional tie-breaking criterion: If two or more tenders are equivalent under the evaluation criteria, preference will be given to the bidder holding the highest number of certificates or other documents demonstrating compliance with quality assurance and/or environmental protection standards.

The evaluation factors of the most advantageous tender in economic terms and their weights:

The financial evaluation (Sf) of the submitted tenders shall be carried out for each Tenderer individually, based on the price indicated in the financial offer.

The total financial evaluation score (Sf) for each Tenderer shall be calculated as follows:

39.1. The economic operator designated as the winner, upon contracting, will mandatorily present the „Declaration regarding the confirmation of the identity of the beneficial owners and their non-classification in the situation of conviction for the participation in activities of a criminal organization or group, for corruption, fraud and/or money laundering" - in accordance with Annex No. 4 of this Participation Notice - original confirmed by electronic signature.

39.2. Tenderers will consider that all information placed by the Tenderer within the AIS "RSAP" M-Tender has a public character. Offer documents that contain confidential information and are attributed to trade secrets, in order to protect intellectual property and personal data, in compliance with Article 17, paragraph (2) of Law no. 131/2015, shall be sent to the contracting authority via email, at [email protected], by the established submission deadline.

39.3. Due to the public nature of the procurement procedure, forms (Technical Specifications, Price Specifications, the ESPD form, and the offer guarantee (where applicable)) will necessarily maintain their public character and cannot be classified as trade secrets or confidential information.
