7. Contract description

The contracting authority - Regional Search and Rescue Directorate No. 2, Balti municipality, will award a contract for the purchase/delivery of one 8+1- seater vehicle ( delivery, technical reception and post-warranty service). The contract covers the technical specifications of the vehicle: seating capacity, emission standards, safety equipment, optional equipment and warranty conditions, with a delivery deadline of 90 days from the registration of the contract with the treasury. Award criteria: competitive financial offer and technical compliance.

A 1% bid guarantee and a 5% performance guarantee were requested .

10. Number of offers

A natural or legal person may submit only one bid, regardless of the form of participation (such as

individual legal entity or as leader or member of a consortium submitting a bid). If a natural or legal person submits more than one bid, all bids in which that person participated will be excluded.

11. Grounds for exclusion

As part of the tender, tenderers must submit a signed declaration, included in the tender form, attesting that they are not in any of the exclusion situations listed in point 18 of Annex II to the Financing Agreement between the European Commission and the Partner Country 1 .

Tenderers included in the EU restrictive measures lists ( www.sanctionsmap.eu ) at the time of the award decision cannot benefit from the contract.

Capacity providing entities

An economic operator (e.g. a candidate or a tenderer) may, where appropriate and for a given contract, rely on the capacities of other entities, regardless of the legal nature of the links it has with them. Where the economic operator relies on other entities, it must demonstrate to the contracting authority that it will have the resources necessary to perform the contract, by presenting an undertaking from those entities to make these resources available. These entities, for example the parent company of the economic operator, must comply with the same eligibility conditions and meet the selection criteria as the economic operator relying on them. In addition, the data relating to this third entity for the relevant selection criterion must be included in a separate document. Proof of capacity will also have to be provided at the request of the contracting authority.

As regards technical and professional criteria, an economic operator may rely on the capacities of other entities only if the latter will perform the tasks for which those capacities are required.

As regards the economic and financial criteria, the entities on whose capacity the economic operator relies become jointly and severally liable for the performance of the contract.

The following selection criteria will be applied to tenderers. In the case of tenders submitted by a consortium, these selection criteria will apply to the consortium as a whole, unless otherwise specified. The selection criteria will not apply to individuals and single-member companies when they are subcontractors.

The economic and financial capacity of the tenderer ( based on point 3 of the tender form). If the tenderer is a public body, equivalent information must be provided. The reference period to be taken into account will be the last three financial years for which the financial statements have been closed.

The selection criteria for each bidder are as follows:

the tenderer's average annual turnover must exceed the maximum annualized budget of the contract, namely the maximum budget indicated in the tender notice divided by the initial duration of the contract expressed in years, if it exceeds 1 year.

Previous experience that would have led to a breach of contract and its termination by a contracting authority cannot be used as a reference. This also applies to the previous experience of experts requested under a fee-based service contract.

16. Award criteria

The contract will be awarded to the offer with the lowest price and compliance with the requested technical characteristics.

17 Deadline for submitting bids

The deadline for submitting bids is July 25, 2026.

18. Offer format and details to be provided

Bids must be submitted using the standard bid form.

The tender must be accompanied by a declaration on its own responsibility regarding the exclusion and selection criteria (form G3).

Any additional documentation (brochure, letter, etc.) uploaded with a bid will not be considered.

19. How to submit offers

Tenders must be submitted exclusively in English to the contracting authority, using the means specified in point 9 of the instructions to tenderers.

Bids submitted by any other means will not be considered.

By submitting a bid, bidders agree to receive notification of the outcome of the procedure by electronic means.

20. Modification or withdrawal of offers

Bidders may modify or withdraw their bids by written notice prior to the bid submission deadline. No bid may be modified after this deadline, in accordance with the rules. SIA RSAP, achiziții.md,

21. Working language

All written communications within this tender procedure and this contract must be written in Romanian.

22. Additional information

23. Origin

10.1 All goods purchased must originate from an eligible source country as defined in Regulation (EU) 2021/948 of 27 May 2021. For this purpose, ‘origin’ means the place where the goods are extracted, grown, produced or manufactured. The origin of the goods must be determined in accordance with the EU Customs Code or the relevant applicable international agreement.

24. General principles regarding payments

26.1 However, if the entrepreneur (seller) is a citizen of the Republic of Moldova, payments will be made in Moldovan lei, according to the exchange rate established by the National Bank of Moldova on the date of transfer.

Payments shall be authorised and made on the basis of any admissible invoice, within 30 days of its signature and registration by the contracting authority. No pre-financing is foreseen.

Payments are authorized and made by the State Treasury of the Republic of Moldova.

26.3 By way of derogation, the final payment to the contractor of the amounts due shall be made within 90 days of the contracting authority's receipt of an invoice and the request for a provisional acceptance certificate.

26.5 In order to obtain payments, the contractor must submit to the authority referred to in point 26.1 above:

26.9 For the execution of the contract, no price revisions are foreseen.

2 5. Data protection

1. The processing of personal data related to the execution of the contract by the contracting authority will be carried out in accordance with the national legislation of the contracting authority's state and with the provisions of the respective financing contract.

Insofar as the contract covers an action financed by the European Union, the contracting authority may communicate to the European Commission communications relating to the performance of the contract. Such exchanges shall be made to the Commission solely for the purpose of enabling the Commission to exercise its rights and obligations under the applicable legal framework and the financing agreement with the partner country – the contracting authority. The exchanges may involve transfers of personal data (such as names, contact details, signatures and CVs) of natural persons involved in the performance of the contract (such as contractors, staff, experts, trainees, subcontractors, insurers, guarantors, auditors and legal advisors). In cases where the contractor processes personal data in the context of the performance of the contract, it shall inform the data subjects accordingly of the possible transmission of their data to the Commission.
