SPECIAL CONDITIONS
CONTENT
These clauses extend and supplement, where necessary, the general conditions governing the contract. Unless the specific conditions provide otherwise, these general conditions remain fully applicable. The numbering of the articles in the special conditions is not consecutive, but follows the numbering of the articles in the general conditions. In exceptional cases and with the authorisation of the Commission services and powers, other CLAUSES may be added for specific situations.

Article 8 Assistance on local regulations

Article 24 Quality of supplies

Article 25 Inspection and testing

Article 26 Principles gEnEral regarding pay
26.1 However, if the entrepreneur (seller) is a citizen of the Republic of Moldova, payments will be made in Moldovan lei, according to the exchange rate established by the National Bank of Moldova on the date of transfer.

Article 28 Late payments
28.2 By way of derogation from Article 28.2 of the General Conditions, after the expiry of the period provided for in Article 26.3 , the Contractor shall be entitled, on request, to interest on late payment at the rate and for the period specified in the General Conditions. The request must be submitted within two months of receipt of the late payment.

29.3 The packaging becomes the property of the recipient, subject to environmental considerations.

Article 31 Provisional acceptance

Article 40 Dispute resolution
40.4 Any dispute arising from or in connection with this Agreement and which cannot be resolved otherwise shall be subject to the exclusive jurisdiction of the specialized court of the Republic of Moldova, depending on jurisdiction, in accordance with the national legislation of the State of the contracting authority.
Article 44 Data protection
1. The processing of personal data related to the execution of the contract by the contracting authority will be carried out in accordance with the national legislation of the contracting authority's state and with the provisions of the respective financing contract.

The exchanges may involve transfers of personal data (such as names, contact details, signatures and CVs) of natural persons involved in the performance of the contract (such as contractors, staff, experts, trainees, subcontractors, insurers, guarantors, auditors and legal advisors). In cases where the contractor processes personal data in the context of the performance of the contract, it shall inform the data subjects accordingly of the possible transmission of their data to the Commission. When personal data are transmitted to the Commission, the Commission processes them in accordance with Regulation (EU) 2018/1725 of the European Parliament and of the Council of 23 October 2018 on the protection of natural persons with regard to the processing of personal data by the Union institutions, bodies, offices and agencies and on the free movement of such data, and repealing Regulation (EC) No 45/2001 and Decision No 1247/2002/EC and as detailed in the specific privacy statement published on ePRAG. ***
