Stimată Autoritate Contractantă,
Vă scriem pentru a vă aduce la cunoștință că, potrivit Legii nr. 131/2015 privind achizițiile publice, impunerea obligativității vizitei în șantier ca o condiție de participare la o procedură de achiziție publică nu este permisă.
Astfel, conform principiilor transparenței, liberei concurențe și tratamentului egal prevăzute de lege, toți operatorii economici interesați trebuie să aibă posibilitatea de a depune o ofertă, fără a fi constrânși de cerințe care le-ar putea limita participarea în mod nejustificat.
Vă rugăm să analizați și să rectificați documentația de atribuire, astfel încât vizita în șantier să devină recomandată, nu obligatorie. Aceasta va asigura respectarea cadrului legal și va permite o participare mai largă a potențialilor ofertanți la această procedură.
Vă mulțumim pentru înțelegere și pentru cooperare.
Ответ заказчика: Stimate Operator Economic vizita la șantier este prevăzută doar pentru a face cunoștință cu proiectul și nicidecum pentru a fi constrînși.
